§ 1 Scope

These Terms of Service govern the use of the online service The Pitch Doctor, provided by Sebastian Nuss, Am Hochgericht 15, 55126 Mainz, Germany.

§ 2 Description of services

The Pitch Doctor is an AI-assisted service for generating exposés for journalistic moving-image formats. The service produces text suggestions based on the topic ideas entered by the user. The generated texts are drafts and do not replace editorial review.

§ 3 Pricing and payment

The prices displayed on the website at the time of order apply. All prices include statutory value-added tax (VAT). Payment is processed via the payment service provider Stripe.

§ 4 Usage rights

The user receives a simple, non-transferable right to use the generated exposés. The generated content may be used for commercial pitches and submissions to broadcasters and platforms.

§ 5 Liability

The Pitch Doctor makes no warranty as to the accuracy, completeness, or timeliness of AI-generated content. The user is responsible for reviewing and approving the exposés. Liability for lost commissions or assignments is excluded.

§ 6 Cancellation

Subscriptions may be cancelled at any time with effect from the end of the current billing period. One-time purchases are excluded from the right of withdrawal because the service is rendered immediately (§ 356 (5) of the German Civil Code, BGB).

§ 7 Final provisions

The law of the Federal Republic of Germany applies. The place of jurisdiction is Mainz, provided the user is a merchant within the meaning of the German Commercial Code.

§ 8 Founding Pricing

Users who join the beta cohort via an approved invitation may receive Founding Pricing: a 12-month lock on their Producer or Studio tier at the rate active at the time of subscription. After the 12-month period, renewals transition to the then-current standard rate, with at least 30 days advance notice by email.

If a user cancels their subscription during the Founding Pricing lock period, the lock is permanently forfeited. Re-subscription at any later date will use the standard tier rate.

Upgrading to a higher tier during the Founding Pricing period locks that new tier at today's rate for the remainder of the 12 months.

Founding Pricing is a time-bounded promotional commitment and is legally binding for the defined duration.
